Dumpster Permit Checker
In Orange County, a dumpster that sits entirely on your driveway is outside the public right-of-way and needs no encroachment permit. In the street it does: 10 of the 26 cities and communities we serve publish a rule for it, from San Clemente’s $91 dumpster encroachment fee to Newport Beach’s $43 Temporary Street Use Permit, and Yorba Linda generally prohibits large construction bins in the right-of-way. Unincorporated Ladera Ranch, Rancho Mission Viejo and Trabuco Canyon go through OC Public Works.

Worked example
A 20-yard bin for a San Clemente remodel: street or driveway
In the street. Permit needed from City of San Clemente Engineering Division (encroachment permit). San Clemente lists “large trash bins, storage units, etc.” among the uses of the right-of-way that need an encroachment permit, and its engineering fee schedule (July 1, 2025 to June 30, 2026, the one posted when we checked) has a $91 dumpster line. Our 20-yard is $650 for 14 days with 3 tons included, so the street placement starts at $650 + $91 = $741 before any extra tonnage.
On the driveway. No street permit for a bin on your driveway in San Clemente: $650. If the remodel has a building permit, the city’s construction and demolition rules apply either way, and San Clemente reminds builders that Prima Deshecha “is not a recycling center.”

Street permits in all 26 cities we serve
Checked September 22, 2026 on each city’s own pages. “Call the city” means we couldn’t verify a rule written for dumpsters; it does not mean a bin in the street is fine without a permit. “Restricted” means the city adds a condition, such as limiting which haulers may place bins, or a general ban.

How to use it
In 4 steps
- 1Pick the city or community where the lot is. Some addresses with a city name are in unincorporated county islands.
- 2Pick where the bin will sit: fully on the driveway or lot, in the street, over the sidewalk or parkway, or on a permitted job site.
- 3Read the verdict and every rule that fired. The fee and the city's permit page come straight from the city.
- 4If it has to go in the street, apply before delivery day, and call or text us about who applies.
Why the street changes everything
A dumpster permit in Orange County is almost always an encroachment permit: permission to put something in the public right-of-way. That’s more than the road. Dana Point’s permit page says curbs, parkways, sidewalks and sometimes the area behind the sidewalk are right-of-way too. Laguna Niguel puts the other half plainly: no encroachment permit is needed when the container is on private property.
Who issues it depends on who owns the road. In a city it’s Public Works or the Engineering Division. In unincorporated Ladera Ranch, Rancho Mission Viejo and Trabuco Canyon, OC Public Works reviews encroachments in the County’s right-of-way, and a private, association-maintained street is the association’s call.
Cities add their own conditions. Newport Beach keeps dumpsters out of alleys, red zones and the 15 feet next to a corner. Costa Mesa’s permit runs 14 days. Costa Mesa and Laguna Niguel limit which haulers may place bins in the right-of-way, so call us before you plan on the street there. Yorba Linda generally keeps large construction bins out of the right-of-way altogether. On a permitted job, the construction and demolition recycling rules ride along no matter where the bin sits: CALGreen’s 65% in most of the cities we checked, 75% in Dana Point and Mission Viejo.
FAQ
Permit checker: questions
Do I need a permit for a dumpster in my driveway in Orange County?
Not a city encroachment permit, as long as the whole bin is on your property. Encroachment permits cover the public right-of-way (street, curb, parkway, sidewalk), and Laguna Niguel's page says outright that none is needed on private property. HOA rules can still apply, and Dana Point's nuisance code covers dumpsters left in view of the street when no construction permit is active.
Who issues a dumpster permit for the street?
The city's Public Works department or Engineering Division, usually as an encroachment permit. Newport Beach calls it a Temporary Street Use Permit and Seal Beach has a dedicated dumpster permit. In unincorporated areas it's OC Public Works, through myOCeServices.
How much does a dumpster street permit cost?
Where a city publishes a fee for a bin in the street, it runs from $41.32 to $205: Costa Mesa $41.32, Newport Beach $43 (without engineer review), Rancho Santa Margarita $64.93, Laguna Niguel $75, San Clemente $91, Seal Beach $205. Dana Point charges a $50 filing fee with more due at issuance, and San Juan Capistrano prices it as a general encroachment permit, $505 for up to two days. Many cities don't publish a dumpster fee at all. Permit fees are separate from our $650 rental.
Can a dumpster go on the sidewalk?
A bin over the sidewalk or parkway is in the public right-of-way just like one in the street, so the same permit applies, and a city may not approve a placement that blocks the walkway. Ask when you apply.
How far ahead should I apply?
Before you book the delivery. Laguna Niguel says review can take up to 10 business days, Yorba Linda up to two weeks, and Costa Mesa about two business days. Newport Beach takes applications in person only, and wants 72 hours' notice to Police Dispatch before temporary No Parking signs go up.
